1. Who you are contracting with

HypeArt is operated by DialPro L.L.C-FZ, a free zone limited liability company registered in Dubai, United Arab Emirates (Licence No. 2204267.01, Registration No. 2204267), registered address Meydan Grandstand, 6th floor, Meydan Road, Nad Al Sheba, Dubai, U.A.E.

By creating an account you enter into an agreement with DialPro L.L.C-FZ. In these Terms, "we" and "us" mean DialPro L.L.C-FZ, and "you" means the account holder.

2. Eligibility

You must be at least 18 years old to use HypeArt. By using the service you confirm that you meet this requirement and that the payment method you use is yours or that you are authorised to use it.

3. Your account

You are responsible for keeping your login details secure and for activity on your account. An account is for one person — please do not share your login with others.

If you lose access to your account, write to [email protected]. We will verify that the account is yours before restoring access.

4. Plans and credits

New accounts receive 150 credits once, on sign-up. The Free plan does not include monthly credits.

Credits are the unit we charge generations in. Current costs:

Images and videos draw on the same credit balance. Credits are deducted when a generation starts. If a generation fails, the credits are returned to your balance.

Unused credits carry over to the following month while your subscription is active. Credits cannot be purchased separately from a plan.

When your subscription ends, any credits left on your balance are forfeited. If you are planning to cancel, use them before your paid period runs out.

We may change prices and credit costs. If we do, we will give notice before the change applies to your renewal.

5. Billing and renewal

Payments are processed by Stripe. Paid plans renew automatically — monthly or annually, depending on the plan you chose — until you cancel. The amount and the next billing date are shown at checkout.

6. Cancelling

To cancel your subscription, write to [email protected] from the email address linked to your account, or open a request through the Contact us button. We process cancellation requests within 24 hours, usually much sooner.

Cancelling stops future charges. Your plan stays active until the end of the period you have paid for. It does not refund a payment already taken — see the Refund Policy.

7. Refunds

Our refund terms are set out in full in the Refund Policy. In short: you can request a full refund within 3 days of a charge if you have used no more than 30% of the credits granted by that payment. Requests go to [email protected] and are reviewed within 24 hours.

8. Your content

Files you upload remain yours. By uploading, you give us permission to store and process them so that we can provide the service you asked for, including sending them to the provider of the model you selected.

You are responsible for what you upload. By uploading a file you confirm that you have the right to do so. If the file shows a real person, you confirm you have their permission.

9. Results and commercial use

Results you generate are yours to use. Commercial use is included on the Plus, Max and Generative plans. Free plan results carry a watermark and are for personal, non-commercial use only.

Generation runs on third-party models, and each provider's own licence applies to what its model produces. We pass on the rights we hold, but we cannot grant more than the provider grants us.

We do not guarantee that a result is free of third-party rights. A generated image may resemble an existing work, a real person, or a protected brand. Checking that your intended use is lawful is your responsibility.

10. What you may not do

You may not use HypeArt to create, upload or distribute:

• Sexual content involving minors, or any depiction that sexualises a minor
• Sexual or intimate imagery of a real person created without their consent
• Images of a real, identifiable person made to suggest they said or did something they did not
• Content that impersonates another person or organisation
• Content that promotes violence, self-harm, terrorism or hatred against a group
• Material that infringes someone else's copyright, trademark or other rights
• Content that breaks the rules of the model providers we work with

You also may not attempt to disrupt the service, bypass credit limits, or access other users' data.

11. If you break these rules

If we find that an account has been used in breach of these Terms, we may suspend or close it. Credits already spent are not refunded.

If you believe the decision was wrong, write to [email protected] from the email address linked to the account. We review appeals within 24 hours and reply with the outcome.

12. Availability

We aim to keep HypeArt running, but we do not guarantee uninterrupted availability. Generation depends on third-party model providers, and their outages affect the service. Generation times vary with load and with the model you choose.

13. Where HypeArt is available

HypeArt is available worldwide, except where its use would breach applicable law or sanctions that apply to us.

14. If we stop providing HypeArt

If we decide to close the service, we will tell account holders by email at least 30 days in advance. During that period you will be able to download your files. Any prepaid period that has not been used will be refunded on a pro-rata basis.

15. Limits of responsibility

We provide HypeArt as it is. We do not promise that a generation will produce a particular result, that the service will be available without interruption, or that it will be free of errors.

We are not responsible for how you use the results you generate, or for any claim brought against you arising from that use.

Where our responsibility cannot be excluded by law, it is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

Nothing in these Terms removes rights you have under the law of your own country that cannot be excluded by agreement.

16. Governing law

These Terms are governed by the laws of the United Arab Emirates, and disputes will be dealt with by the courts of Dubai.

If you live in the European Union or the United Kingdom, this does not deprive you of the protection of mandatory consumer rules in your own country, and you may bring proceedings in your local courts where the law allows.

17. Changes to these Terms

We may update these Terms. The date at the top shows when they last changed. If a change is significant, we will tell account holders by email before it takes effect.
